These Terms of Service govern the access to and use of the Kenetix website and any related informational materials published by Studio9 LLC under the Kenetix brand. These Terms also govern general interactions with Kenetix unless replaced or supplemented by a separate signed agreement.
1. Company Identity
Kenetix is a brand operated by Studio9 LLC, a New Mexico limited liability company.
2. Informational Use Only
All website content is provided for general informational and business marketing purposes only and does not constitute legal, tax, accounting, regulatory, employment, investment, or other professional advice.
3. No Guarantee of Results
Nothing on this website constitutes a guarantee of revenue, sales volume, conversion performance, business growth, or financial outcome.
4. Engagement Required for Services
No website content, inquiry, call booking, or email exchange by itself creates a client relationship. A formal working relationship begins only after Kenetix accepts the engagement and the parties enter into an applicable agreement or confirmed commercial arrangement.
5. Intellectual Property
All content on this website, including text, structure, systems language, process descriptions, branding, graphics, layouts, sales frameworks, and related materials, is owned by Studio9 LLC or used with permission. If liability is imposed notwithstanding the foregoing, aggregate liability shall not exceed the greater of one hundred U.S. dollars (US $100) or the amount paid by the user directly to Kenetix for the specific website-related matter giving rise to the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless Studio9 LLC, Kenetix, and their owners, officers, managers, contractors, employees, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of your misuse of the website, your violation of these Terms, or your violation of any law or third-party right.
11. Governing Law
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules.
12. Arbitration
Any dispute arising out of or relating to these Terms, the website, or related interactions shall be resolved by binding arbitration administered in accordance with commercially reasonable arbitration rules selected by Studio9 LLC, to be conducted in New Mexico, unless applicable law requires otherwise. Each party waives the right to trial by jury to the fullest extent permitted by law.
13. Injunctive Relief
Notwithstanding the arbitration provision, Studio9 LLC may seek temporary, preliminary, or permanent injunctive or equitable relief in a court of competent jurisdiction to protect confidential information, intellectual property, or platform security.
14. Severability
If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.
15. Changes to Terms
Kenetix may update these Terms from time to time. The most current version published on the website will control as of its effective date.
